1. Agreement to Terms

By accessing or using Otherside Cards ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

2. Description of Service

Otherside Cards is a marketplace platform that enables verified artists to auction Magic: The Gathering artist proofs. We provide the technology infrastructure to facilitate these transactions but do not directly participate in the buying or selling of items.

3. Fan Content and Intellectual Property

Portions of Otherside Cards are unofficial Fan Content permitted under the Wizards of the Coast Fan Content Policy. The literal and graphical information presented on this site about Magic: The Gathering, including card images and mana symbols, is copyright Wizards of the Coast, LLC.

Otherside Cards is not produced by, endorsed by, supported by, or affiliated with Wizards of the Coast.

Card data and images are sourced from Scryfall, which is also not produced by or endorsed by Wizards of the Coast.

4. User Accounts

To use certain features of the Platform, you must create an account using Facebook OAuth. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly update any information that changes
• Accept responsibility for all activities that occur under your account

We reserve the right to verify seller accounts before granting permission to create auctions. Verification is at our sole discretion.

5. Auctions and Transactions

For Sellers:

• You must be the rightful owner or authorized seller of any items you list
• Auction listings must be accurate and not misleading
• You are responsible for fulfilling winning bids and shipping items to buyers
• All communication and payment arrangements occur outside the Platform after the auction ends

For Buyers:

• Placing a bid constitutes a binding offer to purchase the item at that price
• You are responsible for completing payment arrangements with the seller
• You should conduct your own due diligence before bidding

7. User Content

Users may upload images and create content on the Platform. By uploading content, you represent that:

• You own or have the right to use the content
• The content does not infringe on any third party's intellectual property rights (except as permitted under the Wizards of the Coast Fan Content Policy)
• The content is not illegal, harmful, threatening, abusive, or otherwise objectionable

We reserve the right to remove any content that violates these terms without notice.

8. Prohibited Conduct

You agree not to:

• Use the Platform for any illegal purpose
• Create fake accounts or impersonate others
• Manipulate auctions through shill bidding or bid shielding
• List counterfeit or stolen items
• Harass, abuse, or harm other users
• Attempt to circumvent any security features of the Platform
• Use automated systems or bots to interact with the Platform

9. Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform will immediately cease.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OTHERSIDE CARDS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE PLATFORM OR ANY TRANSACTIONS CONDUCTED THROUGH IT.

12. Indemnification

You agree to indemnify and hold harmless Otherside Cards and its operators from any claims, damages, losses, or expenses arising from your use of the Platform, your violation of these terms, or your violation of any rights of another party.

13. Changes to Terms

We may modify these Terms of Service at any time. We will notify users of significant changes by posting a notice on the Platform. Your continued use of the Platform after changes are posted constitutes acceptance of the modified terms.

14. Governing Law

These terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
